PRIVACY NOTICE

Goddard Systems, Inc. (“GSI”, “our” or “we”) is committed to protecting your privacy and your child’s privacy. We take our privacy practices very seriously and will treat all of your and your child’s information with respect. This Privacy Notice lets you know how and for what purposes your and your child’s personal information is being collected, processed, and used.

Your use of any web pages, mobile applications, third party social media sites, email lists, online features, services and/or programs offered by GSI (collectively, the “Website”) is governed by this Privacy Notice. Your use of the Website is also governed by our Terms and Conditions.

GSI is the franchisor for a franchise system relating to the establishment and operation of pre-school early learning centers throughout the United States (each a “School”). GSI provides certain rights to third party franchisees (each an “Authorized Franchisee”). Authorized Franchisees can open and run their own Schools under the guidelines established by GSI, but each School is otherwise independent of GSI’s control. GSI itself is not engaged in the delivery of education or instructional services of any type. GSI is not responsible for the operation of any School or for the conduct of its Authorized Franchisees, including any Internet sites that they may operate (whether or not linked to the Website) and their collection and use of personal information. You should refer to the Privacy Notice in effect for your applicable School owner.

Your California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide personal information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year.

To obtain this information, please send an email message to the email address provided at the end of this Privacy Notice with “request for California privacy information” in the subject line and in the body of your message. Please be aware that not all information sharing is covered by the “Shine the Light” law requirements, and only information on covered sharing will be included in our response. Additionally, GSI will only report its own information sharing, not the information sharing undertaken by your School.

California residents who use the Website are entitled to the following consumer rights notice: If you have a question or complaint regarding the services or products provided through the Website, please send an email to helpdesk@goddardsystems.com. Do Not Track

Currently, our policy is that we do not recognize “Do Not Track” requests and signals from Internet browsers and similar devices. We do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser. To find out more, you may wish to visit www.allaboutdnt.com.

Types of Information GSI Collects or Receives

In order to provide you with information and services, we may ask you to provide us with some personal information. GSI stores and uses the information that we collect or receive in strict compliance with applicable state and federal law.

The types of personal information GSI collects or receives may include the following categories of information: (1) contact information such as names, mailing addresses, email addresses and telephone numbers; (2) biographical information such as date of birth, household data and demographic information; (3) banking information such as bank account, credit card numbers and/or other financial information; (4) health information such as health assessments, medical condition information, allergy information, medication information, and immunization status; (5) behavioral information such as injury, accident, incident, illness reports, and crime and police report information; (6) scholastic performance data; and (7) other information provided by Schools. When you submit personal information, you accept that this information will be shared with Schools.

We may also collect information about you regarding your use of the Website when you visit the Website. The types of usage information GSI collects or receives may include the following categories of information: (1) device information such as Internet Protocol (or IP) address, protocol and sequence information, MAC address, device ID/UDID, or similar device-specific code; (2) browser information such as browser language and type; (3) domain name system requests; and (4) browsing history information (including time spent at a domain, time and date of your visit) and number of clicks. We may assign you a unique internal identifier to help keep track of your future visits. Some of our web pages and electronic communications may contain electronic images known as Web Beacons (sometimes referred to as “clear gifs”).

Use of Cookies

From time to time, GSI and/or our advertisers or other third parties may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive. We, our advertisers, and other third parties may use cookies to identify and keep track of, among other things, those areas of the Website and third party websites that you have visited in the past in order to enhance your next visit to the Website. You can choose whether or not to accept cookies by changing the settings of your Internet browser, but your ability to use the Website may be impaired or prohibited. Each browser is a little different, so look at your Help menu to learn the correct way to modify your cookies. Cookies can be deleted by you, at any time, and will not collect any information when you are not accessing the Website. By using the Website, you consent to our use of cookies.

Use of Google Analytics

We may use third party analytics services, such as Google Analytics, in connection with the Website. Such third party services may use cookies and similar technologies to collect and analyze information about use and to report on activities and trends. Such services may also collect information regarding the use of other websites, applications, and online resources. Google’s ability to use and share information collected by Google Analytics about your visits to the Website to another application which partners with Google is restricted by the Google Analytics Terms of Service and the Google Privacy Policy. To prevent your data from being used by Google Analytics, you may download the Google Analytics opt out browser add-on at https://tools.google.com/dlpage/gaoptout.

When We Collect and Receive Information

GSI collects or receives your information when you: (1) request information about a School through the Website; (2) access a GSI social media platform; (3) sign up for any type of notifications from GSI or its trusted partners; (4) provide GSI with comments, suggestions or other input through the Website or otherwise; and (5) provide information to Schools, which they provide to us (see “School Collected Information” below). We may also receive information from third parties that provide us with such information.

School Collected Information

As a part of enrollment and providing you with services, Schools collect and receive personal information about you and your child. The information collected by Schools is often stored on certain of GSI’s secured servers (on our behalf and on behalf of Schools), and may be transmitted directly to our employees and agents for a specific purpose. While Schools are responsible for the collection, storage, and treatment of all information that they collect, we want you to be aware that GSI often has access to some or all of that information.

Use of Information

Information collected or received by GSI is used for four main purposes: (1) we collect information to provide you services and improve your and your child’s experience with GSI and the Schools, as well as the Website; (2) we may now or in the future collect information to personalize the experience of the users of the Website; (3) we collect information to communicate with you (directly or through business partners) and to inform you about the Schools and the products and services of GSI, the Schools, and our business partners; and (4) we use information collected about and from parents and students at Schools, and visitors to the Website, for our internal business purposes (e.g., business planning, program development, and future School locations).

When Information is Disclosed by GSI

We might disclose information to law enforcement, government officials, or other third parties when required by law or in the good-faith belief that such disclosure is necessary to comply with law, enforce this Privacy Notice or our Terms and Conditions, and/or investigate and protect our rights or the rights of others.

We may provide information about you to our Authorized Franchisees and other businesses and persons for the purposes of processing such information on our behalf, providing you information about a current or prospective School or your child’s enrollment at a School, and to provide you information about products and services about which we think you may have an interest or already receive. We require that these parties agree to process such information in compliance with our Privacy Notice or in a similar, industry-standard manner. The use of your information by one of our trusted business partners may be subject to that party’s own privacy notice.

We may share non-personally identifiable information with third parties to demonstrate the usage patterns for GSI’s advertisements, promotions and/or services on the Website. We may also share information with our analytics providers to help us understand your use of our services.

We may transfer your personally identifiable information, as well as any other information, to third parties including buyers or service providers if we are involved in the sale, divestiture, transfer or other disposition of all or part of the GSI business and/or assets, or in the event of our bankruptcy.

Employment Opportunity and Potential Franchisee Information Collection

The Website may allow prospective employees to request or submit additional job opportunity information. The information may then be shared with select Authorized Franchisees and others within GSI who are involved in the recruitment process. The Website also allows you request franchise information. By submitting any of this information, you consent that we and the Authorized Franchisees are permitted to use the information.

Privacy Outside the Website

The Website may integrate with or contain links to other websites, apps, and services. Those third party websites, apps, and services have their own privacy policies and terms of conditions that we do not control. We encourage you to review these third party terms and to contact the third party with any questions you may have.

European Union Users

The Website and our products and services are hosted in the United States and are governed by United States law. If you are using the Website or our products or services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Website or our products and services, you consent to your personally identifiable information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Notice.

We will only process your personal information when we have a legal basis to do so. When we do process your personal information, we will do so with your consent as set forth in this Privacy Notice, or because the processing is necessary for the performance of services or to provide products to you, to comply with our legal obligations, to pursue our legitimate interests, or to establish or defend a legal claim.

If applicable, you may have the following rights under some circumstances, as follows: (1) you may request information about what personal information we have about you; (2) you may request rectification, deletion, and limitation of the processing of your personal information as long as this is legally permissible and possible within the framework of an existing contractual relationship; (3) you have the right to transfer the personal information that you have provided to us on the basis of a consent or a contract; and (4) if you have given us consent for personal information processing, you can revoke it at any time in the same manner that you granted it. Please remember that the revocation of consent does not affect the legality of the processing done before you revoked your consent.

To exercise your rights, please contact us by one of the methods set forth at the end of this Privacy Notice, and we will respond to your request in a prompt manner. We may not be able to accommodate your request in every situation, but if that is the case, we will let you know why. We may charge you an administrative fee for subsequent requests, as permitted by applicable law.

If you are a data subject in the European Union and you believe that our processing of your personal information infringes applicable law, you may submit a complaint with a supervisory authority. Information from Children

Through the Website

The Website is not intended or designed to attract children under the age of thirteen (13) who are unaccompanied by a parent or legal guardian. We do not use the Website to collect personally identifiable information from any person that we know to be under the age of thirteen (13). The sole circumstances under which we would knowingly receive personal information about a child through the Website are instances where the child’s School or parents/legal guardians provide that information to us. We do not currently engage in any marketing activities to your child through the Website.

Outside of the Website

GSI and Authorized Franchisees, and our and their respective service providers, do receive information about your child as a part of offering and providing you and your child our and Authorized Franchisees’ services. By applying for enrollment or enrolling your child at a School, you expressly agree that such School and GSI, and our and their respective service providers, will receive certain personal information about and from your child. As a result of the foregoing described receipt and use of information about your child, you agree:

(1) This Privacy Notice shall serve as notice to you regarding our information practices with regard to children, including the types of personal information we may collect or receive from your child (through the Website or otherwise), the uses to which we may put that information, and whether and with whom we may share that information. You should refer to your School’s Privacy Notice regarding its use of personal information.

(2) You consent to the collection of personal information from your child in any manner.

(3) We have notified you that you have the right to request access to the personal information we have collected from your child, and you have the ability to request that the personal information be corrected or deleted.

Parents and legal guardians should be aware that information that is voluntarily given by a child or others in email exchanges, bulletin boards, or the like may be used by other parties to generate unsolicited communications. GSI encourages all parents and legal guardians to instruct their children in the safe and responsible use of their personal information while using the Internet.

Security

We maintain commercially reasonable security measures to protect the information we collect and store from loss, misuse, destruction, or unauthorized access. Our security includes physical, administrative, and technology-based measures. We use encryption to protect data transmissions. We also safeguard your personal information from unauthorized access, through access control procedures, network firewalls, and physical security measures.

You acknowledge that no security measure or modality of data transmission over the Internet can be guaranteed to be 100% secure. We take security seriously, however, you should not expect that any information provided to us through the Website is free from the risk posed by unauthorized access.

How Long We Keep Your Personal Information

We retain data for as long as is necessary to provide our services and for the purposes described in this Privacy Notice. For example, we may retain billing information as necessary to meet audit requirements. We may also retain information as long as necessary to meet legal requirements, resolve disputes or enforce agreements.

Choices with Your Personal Information

Whether you submit personally identifiable information about you or your child to GSI is entirely up to you. You may decide not to submit such information to us, but we may not be able to provide certain services to you.

You may choose to prevent GSI from disclosing, storing or using your or your child’s personally identifiable information under certain circumstances (“opt out”). You may opt out when the information is used for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization. To opt out, please notify us by using one of the methods at the end of this Privacy Notice, or by following the procedures set forth in an electronic communication from us, if applicable. There are some uses from which you cannot opt out, such as our use, storage, and/or disclosure of your or your child’s personally identifiable information in compliance with applicable laws, rules, and regulations, and when we provide products or services that you have requested from us. As long as your child is a student at a School, you also may not opt out of us and/or an Authorized Franchisee using your child’s personally identifiable information to the extent reasonably necessary (in our sole discretion) for us to provide services to you and your child.

Access and Correction

To access your or your child’s personal information in the possession of GSI and correct inaccuracies of that information in our records, please contact us in the manner specified at the end of this Privacy Notice. We ask individuals to identify themselves and the information requested to be accessed and amended before processing such requests, and we may decline to process requests in limited circumstances as permitted by our business practices and/or applicable laws, rules and regulations.

Your Consent To This Privacy Notice

By using the Website and/or enrolling your child at a School, you consent to the collection and use of information by us, Authorized Franchisees and our respective agents as specified above or as we or they otherwise see fit, in compliance with this Privacy Notice, unless you inform us otherwise by means of the procedure identified below. We may use comments, ideas, information, feedback or suggestions that you may submit in any manner that we may choose without notice or compensation to you.

If we decide to change this Privacy Notice, we will post those changes on the Website. Your use of the Website following our publication of any amendment of this Privacy Notice will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future.
